Whisp Terms of Use

These Terms of Use ("Terms") govern your use of Whisp, an iOS app ("Whisp", "we", "us"). By installing or using Whisp you agree to these Terms.

1. The service

Whisp is a voice-to-text iOS keyboard that uses the Groq Whisper API to transcribe audio you record into text. Whisp is offered as a paid auto-renewing subscription via Apple's App Store. Two plans are available:

• Basic — USD $4.99 per month, after a 3-day free trial. Basic requires you to provide your own Groq API key (free to create at https://console.groq.com). Whisp sends your audio directly to Groq under your Groq account; you are responsible for any Groq usage charges on your Groq account.
• Pro — USD $14.99 per month, with an introductory price of USD $4.99 for the first month. Pro uses Whisp's Groq account; you do not need a Groq API key. Whisp transcribes your audio via its own backend. Fair-use limits apply (see Section 4).

Prices are exclusive of any local taxes and may vary by App Store storefront. The price displayed in the App Store at the moment of purchase is authoritative.

2. Subscription billing

• Payment is charged to your Apple Account at confirmation of purchase.
• Subscriptions renew automatically each month unless cancelled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the current price for the relevant plan.
• You can manage and cancel subscriptions in iOS Settings → Apple Account → Subscriptions.
• The free trial (Basic) and introductory price (Pro) are available only to users who have not previously subscribed. Any unused portion of a free trial is forfeited when you start a paid subscription.

3. Refunds

Refunds are handled by Apple under Apple's standard refund policy. Request refunds at https://reportaproblem.apple.com.

4. Acceptable use

You agree not to:

• Use Whisp to transcribe content you do not have the right to record or transmit.
• Attempt to extract or reverse-engineer the Groq API key used by the Pro plan, or to circumvent the subscription verification.
• Use Whisp in ways that violate Groq's terms of service (see https://groq.com/terms-of-use/) or Apple's App Store terms.
• Use Whisp for any unlawful purpose.

The Pro plan includes a fair-use cap of USD $10 of underlying Groq transcription costs per rolling 30-day window, calculated per Apple subscription account. This cap accommodates typical individual use (multiple hours of dictation per day). If your usage exceeds the cap, the Pro plan's transcription service is temporarily blocked until older usage rolls out of the 30-day window. Older charges drop off day by day, restoring capacity gradually. We may terminate your access to the Pro plan's backend if we detect abuse, with or without notice.

5. Microphone access

Whisp requests microphone access for the sole purpose of recording the audio you choose to dictate. Audio is sent to Groq for transcription as described in our Privacy Policy. You can revoke microphone access at any time in iOS Settings → Whisp → Microphone.

6. No warranty

Whisp is provided "as is" and "as available". We do not warrant that Whisp will be uninterrupted, error-free, or that transcriptions will be accurate. Transcription accuracy depends on Groq's Whisper models and on the quality of your audio input. We do not guarantee any specific level of service availability.

7. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to Whisp is limited to the amount you paid us for Whisp in the twelve months preceding the claim.

8. Changes

We may update these Terms from time to time. Material changes will be posted with a new "Last updated" date. Continued use of Whisp after a change constitutes acceptance.

9. Governing law

These Terms are governed by the laws of Switzerland, without regard to conflict-of-laws principles.
